Performance Royalties – For broadcast uses, cue sheet information must be provided to the publisher of record for the track used. Performance royalties are paid by TV and radio broadcasters, not licensee.
End user License agreement
Please read this agreement carefully. By purchasing and downloading any track from Filmtv-tracks library, you ( licensee ) hereby agree to and are bound by the terms and conditions of this end user agreement.
When you purchase a piece of music(generally musical composition from Filmtv-tracks, our products are licensed, not sold, to you by Filmtv-tracks, for commercial or non commercial use.
License is given for a single project or production
All Filmtv-tracks music licenses are non-exclusive, whereby Filmtv-tracks grants you a limited right to use a certain piece of recorded music, hereby referred to as the “Recording.” This license is valid in perpetuity and for the World unless specifically indicated below. In consideration of the license, you hereby agree to pay Filmtv-tracks a certain license fee according to our website rates. Please see our License options and Pricing.
Music previews, freely available for download on the Filmtv-tracks website, are for internal testing and client approval purposes only and cannot be used for any other purpose including, but not limited to, any unlicensed use in commercial materials, advertisements, digital media or video synchronization.

Digimedia LLC, a corporation organized under the laws of the State of Delaware, USA with principal offices at: Digimedia LLC – 343 Park Ave apt. C2- Nutley NJ 07110. USA
“User” shall mean the individual, legal entity or agent entering into this license agreement or any employee or contractor of such individual, legal entity or agent that edits, manipulates or modifies the Content or is otherwise directly involved in the creative process. All Users shall only use the Content in accordance with the terms of this License Agreement.
“You” or “you” shall mean a single: (i) individual, (ii) legal entity (corporation, partnership, LLC, sole proprietorship, etc.), or (iii) agent acting on behalf of a single individual or entity.
1-COPYRIGHT
The Content is copyrighted and protected under the various laws of the United States, International treaties and other applicable laws. The Content shall remain the sole and exclusive property of DIGIMEDIA LLC, or its licensors. Use of the Content is licensed, not sold, pursuant to the terms of this License Agreement. Use of the Content without agreeing to this License Agreement, or a breach of these License Agreement terms, is copyright infringement.
You may Transfer the music in synchronization to any medium necessary (video, film, reel to reel, digital, etc.) to complete your commercial or non-commercial production without any additional licensing fees. You may produce and sell a product that contains music from the Filmtv-tracks.com library without any additional licensing fees providing the end user of your product is restricted from obtaining direct access to the music for personal use.
The music may not be used unaccompanied or as a solo item, or incorporated into other music catalogues or any device capable of reproducing the music as a solo item.
You must give proper credit to the composer with: all copyrights, licensing, duplication and distribution rights are held exclusively by Filmtv-tracks.com, owned by Digimedia llc Publishing and file proper cue sheets with the appropriate rights agencies (ie ASCAP, BMI, and SESAC).
If your production is to be broadcasted, you are required to file a cue sheet with ASCAP or BMI. Broadcast (Network, public, cable) of this music is cleared through the performing rights society: ASCAP, BMI, SOCAN, PRS, SACEM, whose revenues are collected directly from broadcast station licensing, not from you as a producer. Please read the cue sheet submission
Filmtv-tracks.com provides FREE synchronization for licensed ASCAP/BMI/SESAC National TV Broadcast program content in exchange for cue sheet compliance.
Filmtv-tracks.comgrants you a perpetual, non-exclusive, non-transferable, one (1) User license to use the Content only as provided in this License Agreement. Licenses for multiple-site use and mass-market distribution are sold separately.
2-PERMITTED USES
You may synchronize the Audio Material with audio and/or visual productions or applications such as:
Films, trailers, games and other multimedia projects, Training and marketing presentations, Corporate videos, conventions, business meetings, On-hold messages, Web pages, Interactive programs ( software or video ), Computer games, All public exhibitions: lobbies, storefronts, museum displays, kiosks, etc.
- if you intend to use our music in a tv or radio advertisement, please contact us for a separate license.
Use the Content strictly for: (a) Comp Usage; or (b) the specific type of usage specified in any Invoice, license rights pages on Filmtv-tracks.com website and this License Agreement, including but not limited to: commercial / non commercial, broadcast / non broadcast, public performance or non/public performance, telecast, and distribution, medium in which the Content is placed, length of time, territory, market, or industry, units produced, and any other restrictions.
3-PROHIBITED USES
You may NOT:
-Broadcast the Content [film festivals and local cable broadcast are exempt], on broadcast on
television networks without filling out licensing agency (ASCAP, BMI or your organization in your
country ) cue sheets.
-Reproduction or duplication of Filmtv-tracks.com music for the purposes of giving,
transferring, trading, lending, renting, reissue, redistribution or resale without written permission
from Filmtv-tracks.com.
This license is granted for a single user only.
-Sublicense, distribute, transfer, or assign the Content or rights to the Content.
– Use the Content in any downloadable format intended for multiple distribution including, without limitation, in a product that enables an end-user to create his/her own soundtrack using the Content, in a template-based system that resells products including the Content, in a “build-it-yourself” media tool. Contact us to find out about a special license for such use.
– Resell, assign, transfer, convey or otherwise transfer the Content for use in mobile or wireless devices, including but not limited to mobile telephones, handheld game consoles, and PDAs. Such usage is subject to additional licensing fees.
Please contact us for information on reseller licenses.
– Use the Content as a component of a larger musical composition, including but not limited to, “sample-based” musical productions. Please contact us to find out about a special license for such use.
-Remove any copyright, trademark, watermark, or other legal notice from the Content.
Use the Content or any part of the Content, as part of a trademark, service mark, or logo. http://filmtv-tracks.com// or its licensors retain the full rights to the Content, and therefore you cannot establish your own rights.
-Any expanded use of the Content without the prior approval of
filmtv-tracks.com and the payment of any additional license fee required by
filmtv-tracks.com for such expanded use. You shall promptly notify filmtv-tracks.com of any desire to expand use of the Content for which you have not received filmtv-tracks.com prior approval, and shall pay to filmtv-tracks.com
any additional license fee required by filmtv-tracks.com for such expanded use. Fees assessed for your use of the Content depend on the nature of the rights granted as set forth in the Invoice.
– Use the Content in a way that could be considered racist, defamatory, pornographic, libelous, immoral, obscene, fraudulent or illegal.
Prohibited Media Uses: Use in pornographic, x-rated, sexually stimulating or similar productions prohibited
Use in products or commercial advocating or advertising use of illegal drugs or tobacco prohibited
Use in religious-themed products, commercials or productions advocating for religion prohibited
Use in satan-worship, devil worship, anti-religion or similar extreme productions prohibited
Use in products or productions advocating racial, sexual or similar discrimination or bias prohibited
Use in ads, commercials or productions advocating a political stance of any kind prohibited
Use in productions featuring violence, gore, torture or similar mayhem prohibited
4-TERM
This license agreement is effective for the lifetime of the copyright (50 years +) for the length of this agreement. This license is non-transferable to any other party. Uses may be worldwide and are non-exclusive.This License Agreement will terminate automatically, without notice from Filmtv-tracks.com, if you fail to comply with any provision of this License Agreement. You can terminate this Agreement by destroying the Content, along with any copies or archives, any DVD, CD-ROM or accompanying materials (if applicable), and ceasing all use of the Content for any purpose. Such termination may not effect payment obligations. All our music is delivered as instant downloads, for delayed delivery we apologise for any inconvenience caused by maintenance operations done by our host provider that may happen.
5-EXPORT RESTRICTIONS
You acknowledge that the Music is subject to U.S. export jurisdiction. You agree to comply with all applicable international and national laws that apply to the Music, including the U.S. Export Administration Regulations, as well as end-user, end-use, and destination restrictions issued by U.S. and other governments.
6-LIMITED WARRANTY
Filmtv-tracks.com warrants the mp3, compact disc or dvd on which the music is recorded to be free from defects in materials and workmanship under normal use for a period of two (2) years. We will replace the mp3 or CD to the original owner if he or she returns the faulty product to filmtv-tracks.com
filmtv-tracks.com cannot guarantee, however, that the music contained on the music volumes will meet your specific requirements.
7-INDEMNIFICATION
The Non-Exclusive Licensee agrees to indemnify, defend and hold harmless Digimedia LLC and its affiliates, and their respective officers, directors, employees, owners, agents, representatives, licensors and (sub)licensees (collectively, “Indemnitees”) from and against all claims, expenses (including attorney fees) or other liability arising from the Non-Exclusive licensee’s breach of any of his or her representations, warranties or obligations under this Agreement, and from any and all uses of the Work, including, without limitation, any claims or actions based on infringement or violation of intellectual property rights, libel or slander or other defamation, right of privacy or “false light”, right of publicity or blurring or distortion or alteration whether or not intentional.
Digimedia LLC shall have the right, in its sole discretion, to control the defense of any claim, action or matter subject to indemnification by the Non-Exclusive licensee with counsel of its own choosing. The Non-Exclusive License shall fully cooperate with Digimedia LLC in the defense of any such claim, action or matter.
You agree to reimburse Digimedia LLC for its legal fees, costs and disbursements if Digimedia LLC is successful in enforcing any of its rights under this License Agreement including, without limitation, in connection with any action to collect payment.
8-LIMITATIONS & DISCLAIMER
The Non-Exclusive licensee agrees that neither Digimedia LLC nor its affiliates, nor any of their respective officers, directors, employees, owners, agents, representatives, licensors and (sub)licensees (other than the Downloading licensee), shall be liable for any damages, whether direct, incidental, indirect or consequential, arising from any use or non-use of the Work, even if such parties have been advised, or advised of the possibility, of such damages.
THE WORK IS PROVIDED “AS IS” AND, EXCEPT AS EXPRESSLY SET FORTH IN THIS AGREEMENT, NEITHER PARTY MAKES ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
9-CONSENT TO JURIDICTION
This Agreement shall be governed by and construed in accordance with the laws of the State of Delaware USA, without regard to any conflict of laws principles. Any legal action, suit or proceeding arising out of or relating to this Agreement shall be instituted in a court of competent subject matter jurisdiction in the federal or state courts of the State of Delaware, USA, and the Non-Exclusive Licensee and Digimedia LLC each submit to the personal jurisdiction of such court and waive any right each might otherwise have to claim lack of personal jurisdiction or inconvenience of forum. The United Nations Convention on Contracts for the International Sale of Goods does not govern this Agreement. Notwithstanding the foregoing, Digimedia LLC shall have the right to commence and prosecute any legal or equitable action or proceeding before any court of competent jurisdiction to obtain injunctive or other relief against you in the event that, in the opinion of Filmtv-tracks.com , such action is necessary
10-GENERAL
You represent, warrant and covenant that:
-You are at least eighteen years of age and have the full right and authority to enter into this License on behalf of you and/or your company, employer or principal;
-You do not reside in any country to which export of US products are prohibited or restricted and you may not ship, transfer or export any of the Content into any country or use any of the Content in any manner prohibited by any laws, restrictions or regulations;
-You will not use the Content in any way that is not permitted by this License;
– Your use of the Content will not violate any applicable law or regulation of any country, state, or other governmental entity;
-The information that you provide to filmtv-tracks.com is accurate and true, including, without limitation, all credit card or other payment information and you shall update such information as necessary; and
-You are solely responsible for determining whether your use of any Content requires the consent of any other party or the license of any additional rights. If you are unsure whether additional rights are needed for your use of the Content , you are responsible for consulting with competent legal counsel
– If you are acting as an agent, you must obtain your client/principal’s agreement to the terms of this License.
You acknowledge that you have read this agreement, understand it, and agree to its terms and conditions. Non compliance with the terms of this agreement or failure to pay relevant invoices for the music on time will render our licensing agreement void.
